The answer
ConditionalNew York requires a credentialed preparer only in some cases. Plan scope rather than acreage: Only where the plan includes the Stormwater Management Practice component.
What triggers it: Plan scope rather than acreage: Only where the plan includes the Stormwater Management Practice component.
Credentials that qualify
- Licensed PE
- Registered landscape architect
- Qualified Professional (licensed Professional Engineer, Registered Landscape Architect or other NYSDEC endorsed individual); a New York licensed PE is required for components involving the practice of engineering
New York gates only when the stormwater management practice component is required. An erosion-control-only plan is not gated. An erosion-and-sediment-control-only plan has NO preparer credential requirement. The 4-hour NYSDEC training qualifies a person only under the direct supervision of a licensed PE or RLA. Reconciled against the jurisdiction registry, which found a preparer requirement this entry had missed. Where the two sources disagreed we kept the stricter answer.
What this means for a generated plan
Where a credential applies, or where we cannot confirm that none does, treat a generated document as a complete draft for a credentialed preparer to review, amend and sign. It is not by itself a compliant filed plan, and ours says so on its face.

Does a professional engineer have to stamp the plan in New York?
Practice act citations are routinely overstated on this point. A PE stamp is not required as a general matter in most states with no preparer gate, and where we have not verified it we will not assert either answer. Confirm with the state board or the permitting authority.
