EPA's 2022 Construction General Permit governs here, and we have read it. Below are the requirements that attach to a 3 acre site as a worked example, each cited to the permit section it came from. Screen your own acreage further down and they change with it.

Who may prepare the plan

EPA is the permitting authority. Coverage is under EPA's 2022 CGP, permit area NHR100000. CGP Part 9.1.1 states that if you disturb 100,000 square feet or more of contiguous area you must also comply with RSA 485-A:17 and Env-Wq 1500 and, unless exempt, apply for an Alteration of Terrain permit from NHDES; the threshold drops to 50,000 square feet within the protected shoreline. Whether the AoT regime imposes its own plan preparer credential was NOT verified (des.nh.gov refused automated retrieval), so confirm with NHDES. The 2022 CGP as modified became effective April 8, 2025 and expires February 16, 2027; confirm the successor permit near that date. Credential: the 2022 CGP imposes no SWPPP preparer credential. It does require inspections by a 'qualified person' (Part 4.1), which is an inspection credential, not a preparation credential.

Coverage trigger

The project disturbs 3 acres, at or above the 1 acre threshold, so it needs permit coverage.

The trigger people miss is the second one. A half acre lot inside a 40 acre subdivision is covered, because the larger common plan of development or sale is what counts, not the lot.
